Marriott Data Breach Plaintiffs Plan For ‘Bellwether’ Class Push

Consumer plaintiffs in a hotel-reservation data breach lawsuit against Marriott International Inc. are hoping to get a handful of classes certified by early next year, according to a filing in Maryland federal court.

They plan on pitching a nationwide class and state classes under negligence and contract laws of two or three states, they said on Tuesday in a joint status report filed at the U.S. District Court for the District of Maryland.

They anticipate using “bellwether” consumer plaintiffs and a “funneling” approach with a subset of claims against Marriott and Accenture LLP that they think will be most successful, ...
