A lower court properly dismissed a lawsuit alleging Leadpoint Inc. and Reliance First Capital LLC sent unsolicited text messages to a consumer after he had asked them not to contact him, in violation of the Telephone Consumer Protection Act.

The number that received the messages at issue in the lawsuit was not a residential phone number within the meaning of the TCPA, a threshold requirement for stating a claim under the act, the US Court of Appeals for the Ninth Circuit said Thursday in an unsigned opinion.
