Labor Law Cited in Privacy Class Suit’s Removal to Federal Court (1)

An assisted living chain removed a proposed biometric privacy class it’s facing to Illinois federal court, arguing that the Northern District of Illinois has federal question jurisdiction over the plaintiffs’ claims.

The federal court has jurisdiction because plaintiff Keamber Winters’ claims are preempted by the Labor Management Relations Act, a federal law, Aperion Care Inc. argued in a notice of removal filed Wednesday in the U.S. District Court for the Northern District of Illinois.
