Judge Raises Jan. 6 Cases in Questioning Civil Rights Activist

A Fifth Circuit judge invoked the government’s prosecutions of Capitol rioters on Jan. 6, 2021, as she sharply questioned a civil rights activist’s ties to the Black Lives Matter movement.

Judge Edith Jones made the comparison as the court is being asked to revive a police officer’s lawsuit against activist DeRay McKesson, as the officer alleges McKesson is liable for injuries suffered at a 2013 protest in Baton Rogue. A Louisiana district court judge rejected those arguments last year, finding McKesson didn’t cause the injuries.
