Morgan Stanley Data Breach Judge Aims to Clear Possible Conflict

A New York federal judge is asking counsel in a data breach lawsuit against Morgan Stanley to determine whether he is a potential class member in a pending $60 million settlement.

The proposed class doesn’t exclude the court, family members, or court staff, an “unusual aspect” that has resulted in needing to reassign the case to find a judge who isn’t “disabled from supervising” the litigation, Judge Paul A. Engelmayer wrote in an order filed Thursday in the U.S. District Court for the Southern District of New York.
