Judge Dismisses Cold Storage Biometric Suit for Lack of Standing

An Illinois man’s claim that a cold storage company disclosed his fingerprints to a payroll vendor without consent doesn’t satisfy standing requirements, an Illinois federal court ruled.

There’s “an insufficient risk of future harm” such as identity theft, Judge Edmond E. Chang wrote in the opinion for the U.S. District Court for the Northern District of Illinois. Chang dismissed the case for lack of federal subject matter jurisdiction and remanded it back to Will County Circuit Court, where it was originally filed.
