Data breach victims suing Convergent Outsourcing Inc. persuaded a Washington state federal judge to certify their class to pursue claims that the debt collector failed to implement cybersecurity measures to adequately protect the private information of more than 640,000 people from hackers.
Plaintiffs sufficiently proved the class action mechanism was best suited to address common legal questions raised by the data breach and to distribute any ensuing monetary damages, according to Judge Marsha J. Pechman’s order filed Tuesday in the US District Court for the Western District of Washington.
