A Ninth Circuit panel on Friday partially upheld an injunction halting implementation of a California kids’ safety law, agreeing that claims the law’s requirements for businesses to define and mitigate risks to children violated the First Amendment were likely to succeed.
The panel vacated the remainder of the district court’s preliminary injunction halting the California Age-Appropriate Design Code Act, according to an opinion from the US Court of Appeals for the Ninth Circuit. The lawsuit had been brought by tech trade group Netchoice.
