HSBC Beats Lawsuit Over Recording of Worker’s Personal Calls

HSBC Card Services Inc. defeated a lawsuit alleging it violated the California Invasion of Privacy Act when it recorded the personal telephone calls of an employee at one of its call centers.

A lower court properly found that plaintiff Dalia Rojas gave her implied consent to being recorded, which was sufficient to defeat her claims under both sections of the CIPA at issue in the lawsuit, a divided California Court of Appeals ruled Thursday.
