HMD Trucking Worker Advances Lawsuit Over Face-Scan Collection

Chicago-based HMD Trucking Inc. must defend against a proposed class action alleging it collected the face scans of truckers in violation of the Illinois Biometric Information Privacy Act.

Lead plaintiff Floyd Eskridge adequately pleaded that the information collected by HMD Trucking was “biometric information” under the act, Judge Manish S. Shah of the US District Court for the Northern District of Illinois said May 30.

Shah also rejected the company’s argument that Eskridge’s BIPA claims were preempted by the Federal Aviation Administration Authorization Act, which regulates the trucking industry.
