Health IQ Insurance Services Inc. won its bid to force an individual to arbitrate his claims over unwanted telemarketing calls, after a federal judge in Pennsylvania ruled that the plaintiff had agreed to the company’s terms of use.
Ryan Dobbs filed the proposed class action against Health IQ, claiming that he received four unsolicited calls and two unwanted text messages from the insurer even though his cell phone number is registered on the National Do Not Call Registry, which violates the Telephone Consumer Protection Act.
