Google Seeks Dismissal of Privacy Suit Over Photo Collection

Alphabet Inc.‘s Google said a California federal court should toss a lawsuit over the company’s use of photos in a facial recognition database because an Illinois privacy law doesn’t apply to such consumer claims.

The state’s Biometric Information Privacy Act can’t require a company that “played no role” in collecting photos to seek subjects’ consent for their use, Google’s lawyers said in a filing Wednesday in the U.S. District Court for the Northern District of California.

Google, Microsoft Corp., and Amazon.com Inc. all face potential class actions for using photos without permission to train facial recognition technology.
