Google Fails to Shake Consumer Claims Over ‘Incognito’ Tracking

Alphabet Inc.‘s Google lost its latest bid to toss claims from consumers who sued over being tracked while browsing online in “Incognito” mode.

Consumers can move forward with a claim that Google’s tracking breaches its promises that private browsing would prevent the collection of user data, according to a Wednesday order in the U.S. District Court for the Northern District of California.

Judge Lucy Koh also allowed the consumers to pursue an alleged violation of California’s unfair competition law based on the value of their data.
