Fullstory Inc. defeated a proposed class action alleging it intercepted and recorded the online activities of visitors to the Mattress Firm website without their consent in violation of the Pennsylvania Wiretap Act.
Plaintiff Kenneth Hasson failed to show that Fullstory, a provider of “session replay” software to website operators, had the required minimum contacts with Pennsylvania to establish the court’s jurisdiction over his claims, Judge Marilyn J. Horan of the US District Court for the Western District of Pennsylvania said Tuesday.
Horan dismissed the lawsuit without leave to amend.
