Frames for America Beats Virtual Eyeglasses Try-On Privacy Suit

Online eyewear seller Frames for America Inc. beat a class action lawsuit in Illinois that claimed its virtual try-on function breached consumers’ privacy.

The case is one of several suits targeting retailers that allow online shoppers to virtually try on glasses and makeup for alleged violations of the Illinois Biometric Information Privacy Act, known as BIPA.

A Chicago federal court dropped the consumer privacy claims brought against Frames for America in a Sept. 8 ruling granting dismissal. The ruling found that the company can’t be held liable for alleged BIPA violations.
