Foley Keeps Escape From Software Provider’s Data Breach Claims

A California state appeals court upheld the dismissal of a cross-complaint against law firm Foley & Lardner LLP seeking to hold it responsible for a 2020 ransomware attack because it hadn’t installed the latest security patch.

The lower court correctly ruled that file-sharing software provider Kiteworks, formerly known as Accellion Inc., filed its cross-complaint against the firm after the one-year lawsuit limitation in the user agreement, Associate Justice Cynthia C. Lie said in an unpublished opinion filed Tuesday in the California Court of Appeal, Sixth Appellate District.
