Fire Department Beats Suit Over Fingerprint Timekeeping System

A Louisiana parish and its fire department defeated a lawsuit alleging they required firefighters to submit their fingerprints for a timekeeping system in violation of the Fourth Amendment.

The plaintiffs failed to show that the mandatory collection of fingerprints for timekeeping purposes was unreasonable, even if it did qualify as a “search” under the Fourth Amendment, Judge Wendy B. Vitter of the US District Court for the Eastern District of Louisiana said Monday.

Vitter dismissed the plaintiffs’ second amended complaint without leave to amend, eight months after she granted the defendants’ motion to dismiss their first amended complaint.
