Federal Biometric Privacy Case Halted for State Court Ruling (1)

Two blood plasma companies targeted in a proposed biometric privacy class action won their motion to stay the case’s proceedings.

The companies, Biomat USA Inc. and Talecris Plasma Resources Inc., were sued in June for allegedly violating the Illinois Biometric Information Privacy Act. They filed the motion to stay the case proceedings in August, arguing that a separate case in the Appellate Court of Illinois, a state trial court, would clarify the “unsettled legal question” of the statute of limitations for claims brought under the biometric law.
