A proposed privacy class action against Farmers Group Inc. should be axed because the plaintiff fails to show how he was harmed by the alleged breach of his driver’s license information, the insurance provider is arguing in Nevada federal court.
The risk of future fraud as a result of the breach isn’t enough to confer Article III standing and bring a suit in federal court, Farmers Group argued in a motion to dismiss filed Tuesday in the U.S. District Court for the District of Nevada.
Attorneys representing plaintiff Ronald Stallone didn’t immediately respond to a request for comment.
