Facebook Inc. lost a bid to have the U.S. Supreme Court review how users can sue tech companies in privacy actions, setting up a possible trial that could lead to millions in damages.
The high court declined to review how consumers can bring privacy actions when they don’t claim real-world injuries and potential injuries aren’t imminent.
The decision also means the court won’t consider whether a court can certify a class when there are outstanding questions of law under federal rules of civil procedure.
