Eyemart Express LLC customers failed to sufficiently allege that the eyewear retailer provided personal health information to Facebook through Meta Platforms’ Pixel, a federal judge ruled.
All five plaintiffs failed to assert facts supporting their claims of breach of contract, inclusion upon seclusion, and violations of state privacy laws and the federal Electronic Communications Privacy Act, Judge David C. Godbey of the US District Court for the Northern District of Texas said, entering the dismissal of the proposed class action with prejudice Wednesday.
