Eye care company Alcon Vision LLC argues a privacy case levied against it in Illinois federal court should be dropped because the plaintiffs lack jurisdiction and because their claims are excluded from the Biometric Information Privacy Act under the law’s health care exemptions.
Their claims are also “facially insufficient,” Alcon argued in a memorandum in support of a motion to dismiss filed Wednesday in the U.S. District Court for the Northern District of Illinois.
The plaintiffs’ counsel didn’t immediately respond to a request for comment.
