Dollar Tree Customer Drops Suit Over ‘Deceptive’ Cookie Banner

A Dollar Tree Stores Inc. customer dismissed his proposed class action alleging the discount retailer continued to collect its website visitors’ data even after they rejected the use of tracking tools through a popup consent banner.

Lead plaintiff Marco Walsh filed a notice of voluntary dismissal Wednesday in the US District Court for the Northern District of California, four months after Magistrate Judge Susan van Keulen denied the company’s motion to dismiss the plaintiff’s claims invasion of privacy, intrusion upon seclusion, and violations of the pen-register provisions of the California Invasion of Privacy Act.
