Disney Argues User Data’s not Private in ESPN Wiretapping Suit

A federal California judge pressed attorneys suing the Walt Disney Co. for violating plaintiffs’ privacy rights to prove whether user data allegedly intercepted at the company’s behest was sensitive enough to confer Article III standing at a Thursday motion to dismiss hearing.

Plaintiffs Amin James and David Sevesind alleged in their May 22 complaint that Disney hired third party Oracle America Inc. to use proprietary pixel tracking technology to “secretly” record how users visiting ESPN.com engaged with the site, including what they typed and clicked on, butwithout prior consent.
