Continental Western Insurance Co. must defend a biometric privacy lawsuit against Tony’s Finer Foods Enterprises Inc. under a multi-peril commercial lines insurance policy, a federal court ruled.
The Illinois Biometric Information Privacy Act claims asserted against Tony’s in the underlying lawsuit fell within the scope of coverage provided by the grocery chain’s policy, the US District Court for the Northern District of Illinois said Wednesday. Continental failed to show that any of the policy’s exclusions precluded coverage, the court added.
