Clothing Retailer Sundance Scores End to Consumer Privacy Suit

Sundance Holdings Group LLC—a specialty clothing and household goods retailer—got a federal court to dismiss a suit over the alleged sale of customers’ personal information after Utah amended a consumer protection law to explicitly bar class action remedies.

The US District Court for the District of Utah previously said that federal law controlled because Utah’s Notice of Intent to Sell Nonpublic Personal Information Act didn’t define the scope of the law’s rights or remedies. Recent legislative history has made clear that the law always prohibited moving forward as a class, the court said Monday.
