Clearview Biometric Privacy Case’s Move to Illinois Court Upheld

Clearview AI Inc.'s attempt to keep a proposed class action in federal court for its alleged violations of Illinois’ biometric privacy law was rejected by the Seventh Circuit on Thursday.

A group of consumers alleged Clearview violated the state’s Biometric Information Privacy Act by creating a facial recognition tool with photos scraped from social media without permission. The consumers originally sued Clearview in Illinois state court for violating multiple sections of the BIPA, and Clearview removed the case to federal court before the plaintiffs voluntarily dropped it. They then filed a “new, significantly narrowed” complaint in state court.
