CBIZ Benefits Beats Some Privacy Claims in Cyberattack Lawsuit

CBIZ Benefits & Insurance Services Inc. convinced a federal district court to narrow a proposed class suit from employees of its clients who alleged the company was negligent in protecting their data, which was exposed in a cyberattack.

The plaintiffs’ negligence claim survived CBIZ’s motion to dismiss in the US District Court for the Northern District of Ohio. But claims for invasion of privacy and unjust enrichment were dismissed Monday, as was a negligence per se claim based on the Federal Trade Commission Act.
