Capital One’s $190 Million Data Breach Deal Gets Plaintiff Push

A $190 million deal to end a post-breach class action suit against Capital One Financial Corp. should be approved because the proposed relief is fair, reasonable, and adequate, plaintiffs are arguing in Virginia federal court.

The proposed notice plan for the deal will be effective at reaching approximately 98 million class members, plaintiffs argued in a motion for preliminary approval filed Monday in the U.S. District Court for the Eastern District of Virginia.

Attorneys representing Capital One didn’t immediately respond to a request for comment.
