California Privacy Board Votes That State Law Can’t Be Preempted

California opposes federal privacy legislation unless it allows the state to keep its own requirements or creates a minimum floor—not ceiling—of protections, the California Privacy Protection Agency Board voted Thursday.

The board met after California leaders, including Gov. Gavin Newsom (D), expressed concern that privacy proposals pending in Congress would preempt and weaken state standards by giving precedence to federal law.
