California Entities See Damages Limited for Abuse ‘Cover Up’

California public entities are immunized from enhanced, treble damages to punish for sexual abuse as a result of a cover-up, the state supreme court ruled Thursday.

Justices unanimously upheld an appellate ruling that public entities are excluded from being assessed triple damages under amendments to the state Code of Civil Procedure. The statute was amended in 2019, extending the statute of limitations for childhood sexual abuse and permitting additional damages after proving the assault “was as the result of a cover up.”
