Build-A-Bear Workshop Inc. can keep claims brought over unwanted texts in federal court, according to a judge in Missouri who denied the plaintiff’s motion to remand the proposed class action back to state court.
Benjamin Ruby sued Build-A-Bear in the Circuit Court of St. Louis County, claiming that the company sent him and others unwanted texts in violation of the Telephone Consumer Protection Act.
Build-A-Bear successfully moved the claims to the US District Court for the Eastern District of Missouri in September 2021.
