Bloomingdale’s, Papa Johns Dodge Online Tracking Privacy Lawsuit

A federal appeals panel upheld two lower court rulings against a plaintiff who failed to show injury required for invasion of privacy claims against Bloomingdales.com LLC and Papa Johns International.

Ann Jones, an online consumer, was denied standing for failing to show that session-replay software, which tracks online movements such as keystrokes, revealed her private information, a panel for the United States Court of Appeals for the Eighth Circuit wrote in an opinion filed Tuesday.
