Biometric Privacy Lawsuit Against Logistics Company to Proceed

A proposed biometric privacy class action against an airport baggage operations company may proceed after an Illinois federal judge found the plaintiff’s claims weren’t preempted.

Because plaintiff Eric Nseumen’s Biometric Information Privacy Act claims against DAL Global Services LLC aren’t preempted by the Airline Deregulation Act or the Illinois Workers’ Compensation Act, the lawsuit may advance, Judge Matthew F. Kennelly wrote in an order filed Monday in the U.S. District Court for the Northern District of Illinois.

Attorneys representing DAL didn’t immediately respond to a request for comment.
