Biometric Privacy Case Proceeds Despite BIPA Limitations Question

An Illinois federal judge said his court will decide a dismissal motion in a proposed biometric privacy class action despite the defendant’s concerns that there are outstanding cases at the state and appellate levels that could affect its outcome.

Because the matter has already been fully briefed, the court “sees no reason to delay consideration of the Motion to Dismiss,” Magistrate Judge Tom Schanzle-Haskins wrote in his opinion filed Monday in the U.S. District Court for the Central District of Illinois.
