Binance Gets User’s Biometric-Privacy Suit Sent to Arbitrator

A consumer’s claims that BAM Trading Services Inc. collected her facial scans in violation of the Illinois Biometric Information Privacy Act will be heard by an arbitrator, a federal court ruled.

Plaintiff Candice Wilhelm failed to rebut the company’s evidence that she agreed to the mandatory-arbitration provision in the Terms of Use for BAM’s Binance.US cryptocurrency trading platform, Judge Manish S. Shah of the US District Court for the Northern District of Illinois said Monday.

Shah granted BAM’s motion to compel arbitration, but stayed the case pending completion of the arbitration proceedings instead of granting BAM’s motion to dismiss.
