Louisiana marine and oilfield construction company Berry Bros General Contractors Inc. failed to convince a federal court to dismiss negligence and breach of implied contract claims from a data breach suit.
“With more frequent data breach claims, a circuit split has arisen over whether the mere exposure of” personally identifiable information “to unauthorized actors, without misuse or risk of misuse, constitutes an injury,” Judge James D. Cain Jr. said Tuesday. Cain concluded here that it did, rejecting the company’s motion to dismiss.
