Autotrader.com Online Privacy ‘Tester’ Must Show Standing to Sue

An invasion of privacy claim against Autotrader.com Inc. can continue for now, but the plaintiff must convince a California federal district court that she has standing to sue the company for allegedly deploying spyware on its website.

The court said Autotrader.com didn’t appear to challenge standing with regard to the plaintiff’s claim under a California law prohibiting the use of pen registers to trace a device. It “would appear, however” plaintiff Rebeka Rodriguez would lack standing for that claim because it’s “based on an invasion of privacy that depends on Plaintiff’s expectations,” and she purposefully tested the company’s website for ...
