Associated Wholesale Grocers Beats Suit Over 2023 Data Breach

Kansas-based Associated Wholesale Grocers Inc. defeated a former employee’s proposed class action alleging it negligently failed to protect the personal information of nearly 27,000 people that was exposed in a 2023 data breach.

Lead plaintiff Scott Jenkins didn’t alleged a concrete injury sufficient to establish his standing to sue in federal court, Judge Daniel D. Crabtree of the US District Court for the District of Kansas said Wednesday.

Crabtree granted AWG’s motion to dismiss the lawsuit, without prejudice.
