Two Massachusetts residents succeeded in their bid to return a proposed data breach class action against Anna Jaques Hospital to state court despite other pending litigation over the breach in federal court.
Because plaintiffs Angela Sewell and Milena Vitali-Charewicz filed their lawsuit on behalf of Massachusetts residents only in a proceeding against a Massachusetts hospital, the action was outside the federal court’s jurisdiction, Judge Indira Talwani said Tuesday.
Talwani, of the US District Court for the District of Massachusetts, remanded the case to the Essex County Superior Court.
