Align Technology Must Face Lawsuit Over Unwanted Texts, Calls

Align Technology Inc. lost its bid to dismiss Telephone Consumer Protection Act claims in Wisconsin federal court that the medical device company contacts consumers after they opt out of communications, as a last-ditch effort to market Invisalign.

Anna Gill says that she visited invisalign.com, voluntarily answered a few questions, and provided her email address and phone number to receive more information. A few months later, Gill unsubscribed to communications through her email but still received a text and then a phone call from Invisalign shortly after.
