Ace Hardware’s Cookie Banner Doesn’t Work, Class Suit Alleges

Ace Hardware Corp. was sued by three website users for allegedly continuing to track their online activity through third-party tools even after they opted out of data sharing, violating federal wiretapping laws and privacy protections.

Scott Pflaumer, Hans Cummings, and Mark Rosenthal filed the class action lawsuit claiming Ace Hardware’s website deceived users by placing tracking technologies that intercepted their browsing data before they could interact with cookie consent banners, according to a complaint filed Thursday in the US District Court for the Northern District of California.
