Whistleblower’s New Mexico Medicaid Fraud Suit Set for Dismissal

A whistleblower’s False Claims Act suit alleging that four health-care service providers defrauded New Mexico’s Medicaid program should be dismissed, a federal magistrate judge recommended.

Jacob Kuriyan’s suit against Molina Healthcare of New Mexico Inc., Presbyterian Health Plan Inc., UnitedHealthcare of New Mexico Inc., and Blue Cross & Blue Shield of New Mexico Inc. is barred by the FCA’s public disclosure rule, Magistrate Judge Kirtan Khalsa of the US District Court for the District of New Mexico said in a Monday report and recommendation.
