Texas Fetal Tissue Burial Law Unconstitutional, Court Rules

A Texas law requiring that fetal tissue from an abortion be buried is unconstitutional, according to a federal trial court.

Judge David Ezra of the U.S. District Court for the Western District of Texas Sept. 5 ruled the law violated the equal protection clause and due process clause of the 14th Amendment because it set up unnecessary obstacles for women seeking an abortion while offering minimal benefits. Ezra wrote the state imposed “intrusive burdens upon personal decisions” regarding reproduction and that the law would cause a “near catastrophic failure of the healthcare system designed to serve women of childbearing age” ...
