Tesla Win Over Wheelchair-Accessible ADA Suit Upheld on Appeal

Tesla Inc. defeated claims it discriminated against a quadriplegic man by failing to make accommodations in its Sherman Oaks, Calif., showroom after the Ninth Circuit ruled Monday that the complaint was devoid of factual allegations.

Brian Whitaker’s Americans With Disabilities Act claim fails because he merely recited legal conclusions, the U.S. Court of Appeals for the Ninth Circuit said.

The complaint alleged that Tesla “failed to provide accessible service counters,” that Whitaker “personally encountered” the inaccessible service counters, and that he was denied “full and equal access.”
