Purdue Alleges Proposed OxyContin Generic Infringes Four Patents Covering Pain Drug

Drugmaker Purdue Pharma LP April 10 sued two generic companies over their bid to make a generic copy of Purdue’s painkiller OxyContin (Purdue Pharma LP v. Varam Inc.).

In the suit, filed in the U.S. District Court for the Southern District of New York, Purdue Pharma alleges that an abbreviated new drug application submitted by Varam Inc. and KVK-Tech Inc. to make generic oxycodone hydrochloride extended release tablets infringes four patents covering the pain medication. The companies are seeking to sell their proposed generic product before the four patents at issue expire.
