PTO Changes Patent Term Adjustment Rules to Meet AIA Technical Corrections Act

The Patent and Trademark Office issued an interim final rule on April 1, simultaneously requesting comments and implementing changes to patent term adjustment calculations and proceedings related to patent applications filed under the Patent Cooperation Treaty. 78 Fed. Reg. 19,416 (April 1, 2013).

Section 1(h) of the “Technical Corrections to America Invents Act” (H.R. 6621) called for the changes by its modifications to 35 U.S.C. § 154(b). The modifications affect national applications filed under 35 U.S.C. §111(a) and national stage applications submitted under 35 U.S.C. §371
