Pharmaceutical company Assertio Therapeutics will escape a class action securities suit accusing it of an illegal off-label marketing campaign for its line of opioids, a federal court ruled March 18.
The plaintiffs failed to allege sufficient facts showing that Assertio pursued a widespread scheme off illegal marketing or that it hurt the company’s shareholders, the U.S. District Court for the Northern District of California said.
The court did, however, give the plaintiffs 21 days to file a new complaint fixing those problems.
