The nursing home industry and the state of Texas filed a motion for summary judgment in a federal court in Texas last week to set aside a sweeping HHS rule that requires US nursing homes to meet minimum federal staffing requirements.
In separate lawsuits filed earlier this year, the American Health Care Association, the nursing home industry’s leading trade group, and the state of Texas sued the Department of Health and Human Services in US District Court for the Northern District of Texas over the disputed final rule.
