Supporters for nursing home residents are clinging to the longshot hope that the Trump administration could appeal a federal judge’s decision this week to scrap the Biden administration’s embattled facility staffing requirement.
But legal analysts and policy watchers say an appeal is unlikely, considering widespread opposition to the staffing mandate by congressional Republicans and even some Democrats.
“I don’t think that adding regulatory burdens onto an industry, especially when the legal authority to do so isn’t clear, is something that this administration is going to pursue,” said Duane Wright, a senior analyst at Bloomberg Intelligence.
